Illinois turned its sports-betting tax into one of the harshest in the US — a graduated 20-40% rate in 2024, then a per-wager fee (25-50 cents per bet) in 2025 that pushed FanDuel and DraftKings to add surcharges. Meanwhile an online-casino bill (HB 4797) keeps stalling, and in February 2026 regulators sent cease-and-desist letters to 65 sweepstakes operators.

Online Casino & Poker in Illinois

Illinois is a partial market. Sports betting, casinos, video gaming, and the lottery are all legal — but online casino and online poker are not. Like New York, Florida, and Ohio, Illinois legalized sports betting without opening up iGaming.

There’s a real push to change that. Representative Edgar Gonzalez Jr. has repeatedly filed the Internet Gaming Act (HB 4797), which would legalize online slots, table games, poker, and live-dealer games under the Illinois Gaming Board at a 25% tax. But it keeps stalling in committee — opposed by the casino industry, the powerful video-gaming-terminal lobby, and labor unions, all worried about cannibalizing existing revenue. Nothing has passed, even though neighboring Michigan and Pennsylvania already collect that revenue from regulated online casinos.

Ironically, Illinois’s punishing new sports-betting taxes may add pressure to legalize iGaming as a fresh revenue source. For now, though, Illinoisans who want online poker or casino games play at offshore sites like Ignition, Bovada, and ACR Poker. The state doesn’t prosecute individual players, but offshore sites carry no Illinois oversight. There’s also live poker at the state’s casinos.

The practical reality: Illinois sports bettors use the legal apps (FanDuel, DraftKings, and others) — though the new taxes have brought per-bet surcharges. For online poker and casino games there’s no legal option yet, so most players use established offshore sites and withdraw via crypto.

Casino Gaming in Illinois

Illinois has one of the largest commercial gaming markets in the country — and no tribal casinos. Casino gaming started on riverboats under the 1990 Riverboat Gambling Act, and the 2019 expansion added six new licenses, including one for Chicago.

There are about 16 casinos statewide, led by Rivers Casino Des Plaines (the largest) and the new Wind Creek Chicago Southland. Bally’s Chicago is operating from a temporary site while its permanent riverfront resort is built. (Wind Creek is owned by a tribal hospitality company but runs on a commercial Illinois license, not as a tribal casino.)

The defining feature of Illinois gambling, though, is video gaming: under the 2009 Video Gaming Act, roughly 49,000 video gaming terminals run in bars, restaurants, and truck stops — the largest such network in the US, and a big reason casinos and the VGT lobby resist online-casino legalization.
