Legal under the 2019 Interactive Wagering Act, but online poker didn’t actually launch until June 2025, when BetRivers went live — the first legal online poker in West Virginia. WV joined the Multi-State Internet Gaming Agreement (MSIGA) in November 2023, and BetRivers pools WV players with Pennsylvania, Michigan, and Delaware.
Legal since 2019 and launched in July 2020 — West Virginia was the fourth US state to authorize online casino. Operators include DraftKings, BetMGM, Caesars, FanDuel, and BetRivers, each tied to one of the state’s five casino licenses. iGaming revenue is at record highs, topping $40 million in some recent months.
Legal since 2018 — West Virginia was one of the first states to launch after the Supreme Court struck down PASPA. Retail betting began in 2018 and mobile followed that December. Around eight online sportsbooks operate, including FanDuel, DraftKings, BetMGM, and Caesars.
Legal and widely available. A 2016 Attorney General opinion found DFS is not predominantly a game of chance, and all major operators run contests in the state — though WV has never passed a standalone DFS regulatory statute.
Legal pari-mutuel racing. Thoroughbred racing runs at Charles Town and Mountaineer, and West Virginia is home to two of the last greyhound tracks in the US (Wheeling Island and Mardi Gras). Online advance-deposit wagering is legal, and WV added fixed-odds horse betting in 2025.
Pushed out. In 2025 the Attorney General issued roughly 47 subpoenas to sweepstakes operators, and platforms including Chumba, LuckyLand, and Global Poker (VGW) exited West Virginia by late 2025.
With a full regulated market available, there is little reason for WV players to use offshore sites, and many decline West Virginia players. WV law targets unlicensed operators, not individual players, but offshore sites offer no WV Lottery oversight.
In June 2025, BetRivers launched the first legal online poker in West Virginia — six years after the law passed — joining a shared pool with Pennsylvania, Michigan, and Delaware. The same year, the Attorney General’s subpoenas drove sweepstakes casinos out of the state, and iGaming revenue hit record highs.
West Virginia became the fifth member of the Multi-State Internet Gaming Agreement on November 14, 2023, clearing the way for shared-liquidity online poker with Nevada, New Jersey, Delaware, and Michigan.
West Virginia’s online casinos launched in July 2020, with DraftKings among the first. WV was the fourth US state to offer legal online casino gaming.
The Legislature passed the Interactive Wagering Act (HB 2934), which became law without Governor Jim Justice’s signature — he abstained because he owns The Greenbrier, one of the five licensed casinos.
After the Supreme Court struck down PASPA, West Virginia legalized sports betting (SB 415) and launched retail books in 2018, with mobile following that December — one of the earliest states to go live.
County voter referendums authorized table games — blackjack, roulette, and poker — at West Virginia’s racetrack casinos, expanding beyond the video-lottery slots introduced in the 1990s.
West Virginia authorized video lottery terminals at its racetracks, turning them into “racinos” and laying the foundation for the state’s modern casino industry.
West Virginia legalized online poker back in 2019, but it took six years for the first hand to be dealt. BetRivers Poker finally launched on June 10, 2025 — the first, and so far only, legal online poker room in the state.
What makes it worthwhile despite WV’s small population is shared liquidity. West Virginia joined the Multi-State Internet Gaming Agreement in November 2023, and BetRivers pools WV players with Pennsylvania, Michigan, and Delaware. That four-state network — the second multi-state online poker pool in the US after the WSOP network — delivers bigger guarantees and fuller tables than a state of 1.8 million ever could alone. The compact also includes Nevada.
Note that the BetRivers pool does not include New Jersey, which runs its own separate market. Every operator requires geolocation and identity verification — you must be physically inside West Virginia and 21 or older to play, and VPN use will get your account closed.
One room, for now: BetRivers is currently the only regulated online poker site in West Virginia (and in Delaware). More brands are licensed for online casino, but poker liquidity runs through the BetRivers / Rush Street network.

West Virginia has five commercial casinos and no tribal casinos — the state has no federally recognized gaming tribes. Every online brand must tie its license to one of these five properties.
They are Hollywood Casino at Charles Town Races (the largest, in the eastern panhandle near Washington, DC), Mardi Gras Casino & Resort near Charleston, Wheeling Island Hotel-Casino-Racetrack, Mountaineer Casino Racetrack & Resort in the northern panhandle, and The Greenbrier — the historic resort casino owned by Governor Jim Justice, which is why he declined to sign the online-gaming bill into law.
All five began as racetrack “racinos,” adding video-lottery slots in the 1990s and table games after 2007. Today they anchor a small but fast-growing online market: WV iGaming revenue has climbed more than 50% year-over-year and now runs well over $400 million on an annualized basis.
