Legal. Massachusetts has three gaming venues from its 2011 Expanded Gaming Act — Encore Boston Harbor (the flagship, with New England’s largest poker room, around 24 tables), MGM Springfield (a ~15-table room), and Plainridge Park (slots only). There are no operating tribal casinos.
Legal and regulated. Massachusetts — DraftKings’ home state — was an early mover, with 2016 consumer-protection rules from then-Attorney General Healey; DFS is now permanently legal and taxed at 15%.
Legal but limited. Live thoroughbred racing ended when Suffolk Downs closed in 2019; Plainridge runs harness racing plus simulcast, and online advance-deposit wagering is available.
Legal and one of the most successful in the US. Online lottery (iLottery) was authorized in 2024 and is expected to launch in 2026 — but it isn’t live yet.
Grey area. A ban was folded into the 2026 iGaming bill, but that bill was shelved, so sweepstakes casinos continue to operate without a specific state framework.
Not legal. An iGaming bill (H.4431) to legalize online slots, tables, and poker was sent “to study” in March 2026 — shelving it until at least 2027 — amid opposition from Governor Healey and cannibalization fears. Offshore sites accept Massachusetts players in a grey area.

In March 2026, the legislature sent an online-casino and poker bill (H.4431) “to study,” shelving iGaming until at least 2027. The same session, a bill to raise the online sports-betting tax from 20% to 51% (the “Bettor Health Act”) advanced in committee.
Online sportsbooks went live on March 10, 2023, weeks after retail betting began — quickly making Massachusetts one of the busier markets in the Northeast.
Governor Charlie Baker signed Chapter 173, legalizing retail and online sports betting after years of debate.
Wynn’s flagship resort casino opened in Everett, giving the Boston area a major casino and the largest poker room in New England. The same year, Suffolk Downs ran its last live races.
MGM’s $960 million resort casino opened in downtown Springfield, the state’s first full-scale casino.

Massachusetts is a partial market. Mobile sports betting and DFS are legal, and the casinos run real live-poker rooms — but online casino and online poker are not legal. Like Ohio, Illinois, Virginia, and North Carolina, Massachusetts opened sports betting without opening up iGaming.
There’s an irony here: DraftKings is headquartered in Boston, yet its home state won’t let it run an online casino. A 2026 bill (H.4431) would have legalized online slots, tables, and poker — but the legislature voted to send it “to study” in March 2026, shelving it until at least 2027, with Governor Healey and the existing casinos wary of cannibalizing brick-and-mortar revenue. Neighboring Pennsylvania and Michigan already run booming online casinos.
For now, Bay Staters who want to play real-money online poker or casino games do so at offshore sites like Ignition, Bovada, and ACR Poker. The state doesn’t prosecute individual players, but offshore sites carry no Massachusetts oversight. For legal poker, though, the casinos deliver — Encore Boston Harbor has the biggest room in New England.
The practical reality: Massachusetts sports bettors use the legal apps (FanDuel, DraftKings, and others). For online casino games and poker there’s no legal option yet — most players use established offshore sites and withdraw via crypto, or head to Encore or MGM Springfield for live poker.

The flagship is Encore Boston Harbor, Wynn’s resort in Everett just outside Boston, home to the largest poker room in New England. MGM Springfield anchors downtown Springfield in the west, and Plainridge Park in Plainville is a slots-only racino with harness racing. Encore and MGM both spread live poker; Plainridge does not.
The long-planned Mashpee Wampanoag tribal resort in Taunton — First Light — has been stalled for years by land-in-trust litigation. The tribe opened a small temporary gaming hall in 2025, but the full resort has yet to be built.
The Massachusetts Gaming Commission licenses and oversees sportsbooks and casinos, with its GameSense responsible-gaming program and a Voluntary Self-Exclusion program covering casinos and mobile sports betting.
DFS is regulated by the MGC and the Attorney General's consumer rules; pari-mutuel racing and simulcast are overseen by the MGC. Consumer protections apply to all licensed venues.
No Massachusetts protection. Offshore casino and poker sites are unlicensed — no fund segregation, no dispute recourse. If a site refuses to pay, you have none of the safeguards the regulated market provides.
